12/8/2022 - Notice of Planning Board hearing to review HEFSP

Please take notice that on the 8th day of December, 2022 at 7 o’clock p.m., a hearing will be held before the Burlington Township Planning Board to hear public comment on a proposed amended Housing Element and Fair Share Plan (hereinafter “HEFSP") of the Township’s Master Plan. After public comment, the Planning Board shall consider adoption of the amended HEFSP by way of resolution.

In light of the restrictions imposed by Governor Murphy’s Executive Orders entered as a result of the ongoing COVID-19 pandemic, this meeting will held in a virtual format using Zoom. To participate in the meeting via video

Members of the public participating in the meeting using this format will participate just the same as if they were present at an in-person meeting. There will be adequate opportunity for questions and comments from members of the public following the procedures that also govern regular in person meetings of the Planning Board.

The HEFSP was prepared in accordance with (a) N.J.S.A. 40:55D-28(b)(3) of the MLUL and the mandatory requirements of a Housing Element under the New Jersey Fair Housing Act (N.J.S.A. 52:27D-310) (hereinafter “FHA”), (b) relevant regulations of the New Jersey Council On Affordable Housing (“COAH”), (c) the terms and conditions set forth in the court-approved settlement agreement, as amended between the Township and Fair Share Housing Center (“FSHC”), a non-profit affordable housing advocacy organization located in Cherry Hill, New Jersey, and (d) the conditions of the Judgment of Compliance and Repose (“JOR”) entered by Judge Dow on July 6, 2022. In addition, the amended HEFSP also delineates the actions taken, and to be taken, by the Township to create a “realistic opportunity” for satisfaction of its affordable housing obligations under the FHA and the New Jersey Supreme Court decisions commonly referred to as the Mount Laurel doctrine. 

 Beginning Monday, November 28, 2022, a copy of the HEFSP of the Township’s Master Plan will be placed on file for public inspection in the Burlington Township Municipal Building 851 York Road, Burlington, New Jersey during normal business hours. Beginning Monday, November 28, 2022, the HEFSP to be considered by the Planning Board will also be available in electronic format on the Burlington Township website, on the home page, click on the date of the meeting on the section of the page identifying “Upcoming Meetings” and a new window will open identifying each application and all documents they have provided. For those without internet access, the application and all supporting documents are on-file in the office of the Planning & Zoning Department.  Any party interested in commenting on the amended HEFSP may do so during the public hearing or may submit written comments to the Planning Board prior to the public hearing date.
